The following Terms of Use apply to the access and use of this CIMB-Principal Online Portal ("Portal"). By accessing this Portal and using it, the user(s) agree to be bound by these Terms of Use without limitation and qualification.
1. Notwithstanding anything contained herein, the user(s) agree and acknowledge that although this Terms of Use regulate the user(s) access of this Portal and use of the services herein, the said services shall also be subject to the applicable terms and conditions of any agreements which may govern the subscription and use of the same. As such, this Terms of Use shall be read in conjunction with the terms and conditions of those agreements as may be applicable. Should there be any conflict between this Terms of Use and the terms and conditions of those applicable agreements, the latter shall prevail.
2. The user(s) further agree that access of this Portal and use of the services herein shall at all times be in accordance with all legislation, laws and regulations governing the same and the user(s) shall not, at any time whatsoever, attempt or assist any other person to transmit any content, through this Portal or services herein, which is abusive, defamatory, infringes another person's rights, constitutes a criminal offence or gives rise to civil liability, encourages racism, promotes hatred, contains pornography or pedophilia, contains any viruses or deleterious files and/or is otherwise objectionable to public morals and decency.

The user(s) also agree not to hack or attempt to gain unauthorised access into the Portal and the services herein, disrupt the security of its resources, provide information, which is inaccurate or false, and/or otherwise abuse and misuse this Portal and the services herein. If at any time, the user(s) discover or suspect the occurrence of any of these activities, they are required to notify CIMB-Principal immediately and in failing or delaying to do so, they may be held liable for the same.
4. CIMB-Principal is not obliged to monitor or review any access of this Portal or use of the services herein. However, CIMB-Principal may do so from time to time for its own purposes. In doing so, CIMB-Principal reserves the right to edit or delete any content which violates any of the provisions in this Terms of Use without notice and without any liability whatsoever to anyone for doing so.

CIMB-Principal believes that any and all content which may be viewed on this Portal is accurate as on the date of publication thereof, indicated by its date or the date of a page of this Portal; however no warranty is made as to the accuracy and completeness of such content. Errors or omissions do occur and thus, CIMB-Principal makes no warranties or representations as to the accuracy, reliability and completeness of the content included in this Portal and no reliance upon any parts thereof shall give rise to any claim whatsoever against CIMB-Principal.

At the same time CIMB-Principal recommends that the user(s) further evaluate the quality, adequacy, suitability and usefulness of the content contained in this CIMB-Principal Online Portal as well as the service(s) that CIMB-Principal provides herein.
9. Copyright of this Portal is owned by CIMB-Principal. No part of this Portal may be commercially dealt with in any manner without the express prior written consent of CIMB-Principal. Prior written consent of CIMB-Principal must also be obtained before this Portal may be linked to any other websites. Any person who links to this Portal without the written consent of CIMB-Principal shall be liable for any claim arising out of the unauthorised linking.

While any access to this Portal is currently provided free of any charges, the user(s) agree and acknowledge that CIMB-Principal reserves the sole right and discretion to levy a charge for the same or any service(s) which may be provided herein or any portion thereof at any time in the future, subject always to CIMB-Principal giving the user(s) prior notice of the same.
Further thereto and notwithstanding the same, the user(s) agree and acknowledge that there may be certain services provided herein, whether existing at present or made available in the future, which require the user(s) to register with CIMB-Principal in order to access and use the same. In such instances, the user(s) agree and acknowledge that CIMB-Principal reserves the sole right and discretion to levy a charge for the said registration and/or access to and use of the said services or any portion thereof. For these purposes, the user(s) shall be duly notified of the relevant charges, if any, upon registration and the completion of the registration process, access to or use of the said services thereto shall constitute the user(s) agreement and binding acceptance of the same.
11. It is CIMB-Principal's policy to respect the privacy of any information disclosed by the user(s) pursuant to the access of this Portal and use of the services herein ("Information"). Accordingly, CIMB-Principal will neither edit nor disclose your Information unless required to do so in accordance with any legislation, laws or regulations, to protect CIMB-Principal's rights and property, enforce any provision in this Terms of Use to provide the user(s) with the services herein, respond to any claim that the content violates the rights of another person or as otherwise provided herein.

The user(s) hereby agree to fully indemnify, defend and hold CIMB-Principal, our officers, directors, employees, agents and servants harmless against all damages, losses, expenses and costs (including legal costs and disbursements) which CIMB-Principal may have suffered or incurred, whether directly or indirectly, in connection with or as a result of the user(s) breach of any of the provisions under this Terms of Use.

In the event that CIMB-Principal fail or neglect to enforce any provision or remedy under this Terms of Use for whatever reason, CIMB-Principal shall neither be construed as having waived our rights to enforce the same nor as having waived our rights to any continuing, succeeding or subsequent breach of the same or any other provision in this Terms of Use.
14. Notwithstanding from where the user(s) gain or attempt to gain access to this Portal and/or the services herein, the user(s) agree that this Terms of Use, the performance and conduct under it, the access to this Portal and use of the services herein and/or content and any disputes arising thereunder shall, at all times, be governed by and construed in accordance with the laws of Malaysia. Further the user(s) agree to submit and be bound by the exclusive jurisdiction of the Courts of Malaysia.
The performance of CIMB-Principal's obligations under this Terms of Use are subject always to existing legislation, laws and regulations governing the same and nothing contained in this Terms of Use is in derogation of CIMB-Principal's rights to comply with and conform to any governmental requests or legal requirements relating to the access of this Portal and use of the services herein or in respect of the content or any portion thereof which is provided to or acquired by CIMB-Principal.
A printed version of this Terms of Use and of any notice, message or communication given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Terms of Use, to the same extent maintained in its printed form.
